There’s Zillow, Redfin, Realtor, Homes, and all the thousands of other real estate sites to locate and find your home. Not only that, you have become well-informed about the world of online access to all the real estate information, including how to buy, how to sell, as well as the myriad caveats, what to do, what not to do, and who to do it with. You are also bombarded with commercials that say, “go with me, I’m on TV ads.”

Do you choose by company, by the agent’s website, or by someone you know? Or do you contact the seller’s aka Listing Agent to present an offer for you, they call it a seller’s agent for a reason, they represent the seller. This is where my mission to advocate for first-time homebuyers takes hold, and what sets me apart from the rest. The questions become how do you know their reputation, how do you know they are reliable, and that you can trust them. For this blog, the two most significant changes that home buyers need to be cognizant of are the following:
Per the Department of Real Estate Publication, December 12, 2024, publication
“The settlement terms are extensive, but for this consumer alert, key terms include:
- The requirement that a buyer’s agent obtain a signed representation agreement with their buyer client.
- The agent must obtain the signed representation agreement prior to touring a property and the agreement must address compensation for the buyer’s agent.
- Whatever compensation the buyer’s agent and buyer agree upon shall serve as the maximum amount that the agent may receive for brokerage services from any source with respect to that representation.
Coming January 2025 EFFECTIVE JANUARY 1, 2025
In addition to the nationwide settlement, the California Legislature recently passed Assembly Bill (AB) 2992, which was signed by the Governor on September 24, 2024. Effective January 1, 2025, all buyers’ agents in California will be required to sign a buyer-broker representation agreement with their buyer clients as soon as practicable, but no later than the execution of the buyer’s offer to purchase real property.”
Are You Ready to Move Forward?: When you reach that point, I can explain the process and its nuances. Please note that the buyer broker agreement has always been in place, but it is now a mandatory form that you, as a buyer, must complete. Don’t let it scare you, for we can always include in the offer that you can ask the seller to cover the commission, whereby, and large, they still do. The only difference is that it’s no longer a given; the buyer must be willing to enter into a compensation agreement if the seller chooses not to provide the commission. Alternatively, you can move on until you find a seller willing to do so. Everything is negotiable, and you also have a cancellation clause if you decide not to proceed. However, understanding the new 2025 laws is crucial to agency practice and setting clear expectations. Most important takeaway is that the seller providing the commission is not a given any longer, and the buyer broker agreement is puts that to pen.
